What is REACH?
REACH is basing on Registration, Evaluation, Authorization and Restriction of Chemicals. Moreover, it has upgraded the former legislative framework on chemicals of the European Union (EU) since 1st June 2007.

Which field regulated by REACH?
The main aim of this regulation is to addresses the production and use of chemical substances, and ensure a high level of protection of human health and the environment from the risks that can be posed by the most chemical industries, which do not only affect the European businesses but also influence other global businesses.

The short introduction of CMSR
  • Notification
  1. Notify all substances that are placed in Qty > 1 TPA
  2. Key data required: Spectra, Hazard Classification, Uses, DU if any, Tonnage Band, Storage Capacity, SDS (Rule 9(2).
  3. Annual update by 1st March each year – tonnage (actual); new/change information; if tonnage change (fee difference).
  4. Registration within other regulations / Acts – are also required to Notify with ICMS Rules.
  5. Late Notification
  • New Substance (60 days prior to placing)
  • Existing Substance: if missed notification window – 60 days prior to placing it in the market.
  • Registration
  1. Registration - Substances listed in Schedule II.
  2. Technical Dossier needs to be prepared.
  3. Registration fee is applicable – Company Size & Tonnage.
  4. Registration within 18 months after inclusion in Schedule II.
  5. Chemical Safety Assessment (report) for > 10 TPA.
  6. Option to jointly submitting the registration.
  7. Currently Schedule II contains 750 substances.
  8. Exposure Scenario Assessment (report) for < 10 TPA.
  9. Update Technical Dossiers - within 60 days of any change or revision in the information.
  • Priority Substance
  1. Currently 750 substances are listed as Priority Substances in Schedule II. – Notify & Register.
  2. Schedule II will be updated from time to time.
  3. labelling and packaging requirements (Rules 33 & 34).
  4. Import of Priority substances: Inform Authority 15 days before importation. (Rule 27).
  5. Certain Priority Substances may qualify as – Hazardous Substances (Rule 16(3)).
  • Restriction
  1. Substances that are Listed in Schedule VI: Restricted or Prohibited Substances.
  2. As on today, only one substance restricted: Phosgene (carbonyl chloride).
